This is a real, legally binding agreement. Read it before you accept it, the same way you would anything else you sign. It is not a substitute for your own legal or financial advice, and nothing in it should be read as legal advice to you.
In plain terms, before the formal version below:
WireRally publishes trade ideas. It does not know your finances, does not manage your money, and does not decide anything for you — you approve every trade yourself, choose the size yourself, and it executes in your own brokerage account. Because of that, nothing here is personal advice to you, and WireRally is not acting as your investment adviser or broker. Trading has a real risk of loss, including losing everything you put in, and you take that risk yourself. To the fullest extent the law allows, WireRally is not liable for losses from trades you chose to place.
1. Acceptance of these terms
By creating an account, or by using WireRally in any way, you agree to be bound by this Terms of Service ("Agreement"). If you do not agree, do not create an account and do not use the service. If WireRally publishes a revised version, continuing to use the service after being asked to accept it means you agree to the revision.
2. Who can use WireRally
You must be at least 18 years old, or the age of legal majority where you live if that is older, and legally able to enter into this Agreement. You are responsible for making sure your use of WireRally is lawful where you live and where your brokerage account is held. If it is not, you may not use the service.
3. What WireRally is — and is not
WireRally publishes trade signals — a company, a direction, a price to enter at, a price to take profit at, and a price to cut losses at — and keeps a public record of how they perform. Every signal is identical for every subscriber. WireRally does not tailor any signal to your finances, your holdings, your goals, or anything else about you, and does not know those things.
You decide whether to act on a signal. If you do, you choose how many shares, and the trade is placed in your own brokerage account through your own connection to your own broker. WireRally does not send an order to your broker without your specific approval of that specific trade, does not hold your money or securities, and does not have standing access to your brokerage account.
Some signals can also be acted on outside the standard 9:30 a.m.–4:00 p.m. Eastern trading session — including before the market opens, after it closes, and during any overnight trading session your broker makes available — where your broker's own rules permit it and you have specifically approved that trade, at a price you specify yourself, for that specific order. An order placed outside regular trading hours may remain open and unfilled for longer than one placed during regular hours, and is canceled according to your broker's own rules, not WireRally's.
A signal may link to a news story behind it. That link points to a third-party publisher's own site, which WireRally does not control and is not responsible for — a link that worked when a signal was published can later break, redirect, or lead to different content, because the publisher moved, removed, or changed the page, not because of anything WireRally did. WireRally is not responsible for the content, availability, or accuracy of any page reached through such a link.
4. This is not investment advice
WireRally is not a registered investment adviser, is not a broker-dealer, and does not provide personalized investment advice, financial planning, or portfolio management of any kind. Nothing published by WireRally — a signal, a scorecard, a chart, or anything else — is a recommendation that any particular security or strategy is suitable for you, and none of it accounts for your financial situation, your investment objectives, or your risk tolerance.
WireRally's content is impersonal and published to every subscriber alike, in the way a financial publication or newsletter is. It is offered as general information about a fixed set of publicly traded securities, for you to evaluate and act on, or not, entirely at your own discretion. No part of your relationship with WireRally is advisory, and no fiduciary duty is owed to you by WireRally in connection with the service.
WireRally's operator may also be a subscriber, holding a brokerage account and acting on the same signals published to everyone else — on the same schedule and terms as any other subscriber, never earlier. The operator may also hold positions in the same securities through other, unrelated accounts, including an outside brokerage, IRA, or 401(k) account. The strategy that generates signals takes no account of what the operator or any subscriber holds, anywhere, and no signal is ever created, changed, or withheld because of it.
5. Trading involves risk, and results are not guaranteed
Buying and selling securities carries a real risk of loss, up to and including the loss of your entire investment. Past performance — including any track record, win rate, or backtested estimate WireRally publishes — is not a guarantee or a reliable indicator of future results. A signal that performed well before may not perform well again, and a signal may reach its stop-loss price rather than its target.
A stop-loss is an instruction to sell, or for a short sale to buy back, once the price reaches a set level. If the price jumps past that level, for example when the market opens, the sale can happen at a worse price, and the loss can be larger than the stop price suggests.
When you protect a trade with a trailing stop, your entry and its protective stop are two separate orders, the stop placed only once your broker confirms the entry has filled — not two legs of a single bracket submitted together. If the stop cannot be attached right away, your position is temporarily without one; WireRally will prompt you to finish attaching it and continues trying while you have that screen open, but does not guarantee the timing of a protective stop, and you are responsible for checking that one is actually in place.
You are solely responsible for evaluating any signal, for deciding whether and how much to trade, how to protect the trade, and any limit price or trailing-stop percentage you set yourself, and for the consequences of those decisions. WireRally does not guarantee any level of performance, profit, or protection against loss.
WireRally's scorecard and published win rate track how each signal performed against the price it published — not your own portfolio. Your own results depend on which signals you chose to act on, how many shares you bought or sold, and when — decisions only you make, which WireRally's scorecard does not and cannot reflect. To track your own portfolio's actual performance, use the tools your broker provides.
6. Your broker is a separate company
Any brokerage account you connect to WireRally — for example, an account with Alpaca Securities LLC — is provided by that broker, not by WireRally, and is governed by that broker's own agreements, disclosures, and fees. WireRally is not a party to your account agreement with your broker and is not responsible for your broker's actions, availability, order execution, pricing, or the safety of assets held there.
Your broker credentials are held only on your own device and are used only to transmit an order you specifically approved. WireRally does not store them and cannot access your account independently of a trade you approve.
Because your brokerage account belongs to you and is held directly with your broker, WireRally has no ability to prevent you, or anyone else with access to your account, from separately editing, canceling, or placing an order directly through your broker's own platform — whether or not that order originated from a WireRally signal. WireRally is not notified of, and has no visibility into, an action you or anyone else takes directly with your broker outside WireRally, and you are solely responsible for it.
7. Your account, and your decisions
You are responsible for keeping your WireRally account secure, for the accuracy of information you provide, and for every trading decision made from your account, whether made by you personally or by anyone you allow to use your device or credentials. You agree not to misuse the service — including attempting to interfere with it, reverse engineer it beyond what the law allows, or use it to violate any law or any third party's rights.
The Avoid borrowing setting. If you turn on Avoid borrowing, WireRally checks each trade you approve against the cash in your Alpaca account. It does not send your broker an order that looks like it would borrow money or shares. It also tells you when it finds your account borrowing. This is a best effort, not a guarantee. Prices can change between the check and the moment your broker fills the order, so a trade can still borrow. You choose the number of shares in every trade. You are responsible for any borrowing in your account and what it costs.
8. No warranty
WireRally is provided "as is" and "as available," without warranty of any kind, express or implied, including — to the extent the law allows — warranties of merchantability, fitness for a particular purpose, title, and non-infringement. WireRally does not warrant that the service will be uninterrupted, error-free, secure, or that any signal, price, or figure published is accurate, complete, or timely.
9. Limitation of liability
To the fullest extent permitted by law, WireRally, its operator, and anyone acting on their behalf will not be liable to you for any trading loss, lost profit, lost opportunity, or any indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of the service, any signal published through it, or any trade you place — whether the claim is based on contract, tort (including negligence), or any other legal theory, and even if advised of the possibility of such loss.
Where a jurisdiction does not allow some or all of this limitation, the limitation applies to the maximum extent that jurisdiction permits, and WireRally's total liability to you for any claim arising from the service will not exceed the amount you paid WireRally, if any, in the twelve months before the claim arose.
10. Indemnification
You agree to defend and hold WireRally and its operator harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the service, your trading decisions, or your breach of this Agreement — except to the extent caused by WireRally's own violation of this Agreement or applicable law.
11. Not legal, tax, or accounting advice either
Nothing WireRally publishes is legal, tax, or accounting advice. Trading has tax consequences that depend on your own circumstances. Speak to your own qualified professional before relying on anything here for those purposes.
12. Changes to the service and to this Agreement
WireRally may change, suspend, or discontinue any part of the service at any time. WireRally may also update this Agreement; when a change is material, you will be asked to accept the new version before continuing to use the service, and your prior acceptance does not carry forward to it.
13. Subscriptions, cancellation, and refunds
WireRally has a free plan and a paid subscription. The free plan works only with a simulated or practice ("paper") account with your broker. It shows every signal for a period after you create your account, then a limited number of signals each day. We may change what the free plan includes, and how long, at any time. Trading with real money, and some other features, require a paid subscription.
The subscription is billed in advance, monthly or yearly, through WireRally's payment processor, Stripe, and renews automatically at the end of each billing period until you cancel. A subscription may start with a free period, as offered when you subscribe; your card is charged when that period ends unless you cancel before then.
You may cancel your subscription at any time from Account Settings. Canceling stops the next renewal: your subscription stays active until the end of the billing period you have already paid for, and then ends. If you cancel during a free trial, you are not charged.
Once you subscribe, the subscription is charged in full whichever brokerage account you connect, including a practice account, and whether or not you approve or place any trades. Using a practice account is not a reason for a refund.
Payments are not refundable, including for any unused part of a billing period, except where the law requires otherwise. Closing your account immediately (section 14) ends your subscription at the same time, without a refund for the rest of the billing period.
14. Ending this Agreement
You may stop using WireRally and close your account at any time from Account Settings, either immediately or, if you have a paid subscription, at the end of the billing period you have already paid for. If you choose the end of the period, your account keeps working until then, your subscription does not renew, and you may change your mind before that date. Closing your account is permanent: once it closes, you will not be able to sign in to it again. Your brokerage account is separate and is not affected. WireRally may suspend or close an account that violates this Agreement or that WireRally reasonably believes puts the service or other subscribers at risk. Sections of this Agreement that by their nature should survive — including sections 4, 5, 8, 9, 10, and 11 — continue to apply after your account ends.
15. Governing law
This Agreement is governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws principles. Any dispute arising from this Agreement or your use of WireRally will be brought in the state or federal courts located in New Jersey, and you consent to that venue.
16. Entire agreement; severability
This Agreement, together with any policy it refers to, is the entire agreement between you and WireRally regarding the service and replaces any earlier agreement on the same subject. If any part of this Agreement is found unenforceable, the rest remains in effect, and the unenforceable part will be read to achieve its intent as closely as the law allows.
